1. Agreement to Terms

By accessing or using ValidMail ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Description of Service

ValidMail provides email verification and validation services through our web application and API. Our services include:

  • Single email address verification
  • Bulk email list verification
  • API access for programmatic verification
  • Reporting and analytics on verification results

3. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and API keys
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Service to:

  • Verify email addresses obtained without proper consent
  • Send spam, unsolicited emails, or engage in email harvesting
  • Violate any applicable laws or regulations, including CAN-SPAM, GDPR, or CCPA
  • Attempt to probe, scan, or test the vulnerability of the Service
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to verify email addresses for illegal purposes
  • Share your API keys or account credentials with third parties
  • Exceed the rate limits or usage quotas of your plan

Violation of this Acceptable Use policy may result in immediate termination of your account without refund.

5. Pricing and Payment

5.1 Subscription Plans

ValidMail offers various subscription plans with different features and usage limits. Current pricing is available on our website and may be updated from time to time.

5.2 Payment Terms

  • All fees are quoted and payable in US Dollars (USD)
  • Subscription fees are billed in advance on a monthly or annual basis
  • Payment is processed through our payment provider, Paddle
  • You authorize us to charge your payment method for all fees incurred

5.3 Taxes

All fees are exclusive of taxes unless otherwise stated. You are responsible for paying all applicable taxes, including VAT, sales tax, or similar taxes based on your location.

5.4 Price Changes

We reserve the right to change our prices at any time. Price changes will be communicated at least 30 days in advance and will take effect at the start of your next billing cycle.

6. Refunds and Cancellation

6.1 Refund Policy

We offer refunds in accordance with our Refund Policy. Generally:

  • You may request a refund within 14 days of your initial purchase if you haven't used more than 10% of your credits
  • Refunds are not available for partially used subscription periods
  • Credits purchased separately are non-refundable once used

6.2 Cancellation

You may cancel your subscription at any time from your account dashboard. Upon cancellation:

  • Your subscription will remain active until the end of the current billing period
  • No refunds will be provided for the remaining period
  • Unused credits will expire at the end of the billing period
  • Your data will be retained for 30 days, after which it may be deleted

7. API Usage

7.1 API Keys

API keys are provided for programmatic access to the Service. You are responsible for:

  • Keeping your API keys confidential
  • Not sharing API keys in public repositories or client-side code
  • Rotating API keys if you suspect they have been compromised

7.2 Rate Limits

API access is subject to rate limits based on your subscription plan. Exceeding rate limits may result in temporary throttling or suspension of API access.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

Email addresses you submit for verification are processed in real-time and are not permanently stored unless you explicitly choose to save verification history.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by ValidMail and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to the data you submit to the Service. By using the Service, you grant us a limited license to process your data solely for providing the Service.

10. Service Level and Availability

10.1 Uptime

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access and may perform maintenance that temporarily affects availability.

10.2 Accuracy

While we strive for high accuracy in our verification results, we cannot guarantee 100% accuracy. Email verification is subject to limitations including catch-all domains, greylisting, and temporary server issues.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that verification results will be 100% accurate.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VALIDMAIL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless ValidMail and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of any applicable laws

14. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and data
  • Any outstanding fees will become immediately due

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ValidMail operates, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Acceptable Use Policy, constitute the entire agreement between you and ValidMail regarding the Service.
